“Justice must not only be done, it must be seen to be done”.
This is one of the most important tenets of a fair society that everyone before the law is given equal consideration to fight and present their case before a Court of Law.
So, what does it say that Glasgow girl Precious Mhango has been given just 20 minutes to fight her deportation to Malawi?
It says quite a lot, it says that her hearing is more about process than judgement and justice.
Precious Mhango wasn’t born Scottish, she wasn’t born in the UK, she is however Scottish by circumstance rather than birth.
This little girl came here when she was three years old, she is now 10.
Her mentality, her very being is Scottish to its core that cannot be wiped out by deportation.
Now, she and her mother, Florence have to face an oral hearing where their lawyer will get 20 minutes to outline why they should be allowed to stay in Scotland.
20 minutes on which the future of her entire life will hinge.
So, what should the verdict be?
I would say that they should be allowed leave to remain, too much time has elapsed and this is a special case.
When the Tory/Lib Dem coalition took over there was much talk by David Cameron about respect between the London and Edinburgh Governments.
Scotland has come out and said these two people must be allowed to stay, the Home Secretary Theresa May has ruled out using her discretionary powers to stop Precious and Florence being deported.
The respect agenda died quickly between London and Edinburgh.
They aren’t getting justice in a Court of Law; their fate is a political matter.
But are Scottish politicians doing enough?
No, this problem should have been dealt with long ago.
It should be put bluntly to the English Government, if these two people aren’t going to be allowed to stay then the foreign prison operated by the English on Scottish soil will be closed using any and all relevant legislation at the disposal of Government.
They will have to make alternative arrangements for asylum seekers.
What does it say that Holyrood is so ineffective that two people can be removed from Scottish soil against the wishes of people of Scotland?
It says it is time to be a little less nice and a little less understanding.

I take a different view; this little girl has been brought up as Scottish; by any stretch of the imagination this cannot be removed by deporting her.
She might have been born in Malawi but she isn’t like them.

Even Labour’s Margaret Curran said this was wrong.
It is time Scotland’s political elite got serious at Holyrood.

I do not think that it is proper though that immigrants can come to this country, get pregnant, have their child in this country and then hold the country to ransom by fighting their case that their child was born in the uk.
ReplyDeleteWe see this time and time again by people who come from other countries, get pregnant then apply to stay because their child is born here. That to me is wrong and the immigration policy in this country is a total farce and need to be changed.
Even if this little girl was born in Malawi, Malawi is her country of origin and should be returned there.
All her avenues of appeals have been exhausted and this oral hearing in october is just "lip service" and can see it going no-where.
On watching UK Border Agency at work on tv recently it just showed me how these people's hands are tied when it comes to immigration by detaining, then allowing bail and then the immigrant escapes.
To me, and many others, if they are here illegally, and caught, then they should be detained until their papers are in order to be sent back to their country of origin.
UK immigration is a disgrace in this country and it struck me the other day when i was walking through the city centre with friends, just how much foreign people are in this country and i'm not talking about foreign tourist either. A comment was recently heard in a pub the other day about this country being a third world, the person saying this had a point.
As for the Scottish Goverment taking a stance and doing more, they are just pathetic wimp's and have no backbone when it comes to dealing with matters surrounding Scotland and i can guarantee that at next year election i will not be supporting ANY of the political parties in Scotland as they are all a sad bunch of muppets with no real backbone, and as for Kenny MaCaskill, he should just resign from his post and leave as he is no use to this country at all.
Why are these two Malawi citizens still evading deportation to their home after seven years! I am fed up funding these two through my taxes. I am fed up with Anne McLaughlan's personal crusade to keep the pair here any longer.
ReplyDeleteNow she has got more time until a further blooming appeal to get another appeal. She should not have had a judicial appeal in the first place but what is the point of that expensive appeal if this crusading MSP's personal attachment to the pair refused to let them go.
In fairness they must be be returned soon.
They had their “fair trial”, - 5 times - each time their claims to remain in the UK were found to have no merit or substance. They were judged to have no legal or moral right to stay in the UK. They were informed to prepare themselves for deportation, the chose not to turn up for their deportation flight.

Enquiries about those who are assisting and have assisted in the Mhango’s absconding and concealing should be made, and if found, they should be brought before the criminal courts.

She was born in Malawi to Malawian parents - she lived in Malawi for three years.
She was brought to England - she lived in England for three years.
She was brought to Scotland - she has lived in Scotland for 3 / 4 years.
“By any stretch of the imagination”, how can being born in Malawi, (she is Malawian by birth) be removed by taking her from Malawi to England?
When “Precious” arrived in England from Malawi, did “Precious” become English?
When “Precious” arrived in Scotland from England, did “Precious” become Scottish?
Your claim of “Precious” being Scottish is without substance - hence their lawyers never resorting to using the “Precious is Scottish / Glaswegian route.
Neither Florence nor “Precious” are Glaswegian, Scottish or British - they are both Malawians.

ReplyDeleteNow, I am Scottish, and damned proud to be so... equally, I am very pleased to be British too. However, if I thought for one moment that an Independent Scotland would not degenerate into a PC, leftist, economic basket-case, I would vote SNP - I don't, and never will!
Lastly, I have spent some time in Malawi, and I certainly don't recognise the description of its society, as laid out by Mrs Mhango! She is, quite naturally, prepared to lie, pull the wool, do anyhing, to support her non-existant case, and of course, her version will be unquestioned by her supporters on the Left, the very people who are destroying our Society, with they're "open-doors" Immigration policy!

ReplyDeleteGlasgow City Council brought the asylum seekers to Glasgow for a two-tier payment of £250,000,000 (sic) with the Home Office. The first batch of 475 mainly Kosovans arrived ten years ago. Since then the numbers of assorted asylum seekers have swelled to thousands.
Opening up the city to thousands of asylum seekers also opened up Glasgow to thousands of “freedom of movement” migrants who were transported here. Glasgow is a recognized dropping-off ground. That’s why their transporters offload the Roma here. The Roma don’t choose to come to Glasgow - they are directed here, brought here.
The third tier of the Home Office money agreement is on the cards, shortly. Glasgow will no doubt go for the third deal to fill its cash-strapped coffers.
More Roma, more asylum seekers, more assorted wandering nomads on their way to Glasgow, but why would our politicians or councillors care, they don’t have to live with them, or take their place in the NHS queues with them, or their children don’t have to attend school with the foreign offspring who cannot speak, read or write English.
